Foreclosures
The foreclosure process can be complicated and confusing. Having an experienced foreclosures attorney can aid in your ability to fully exercise your rights. The foreclosure process starts with a notice of default. This begins a 90 day time period in which action may be taken to prevent the foreclosure. Once the 90 day period expires, you will receive a notice of trustee sale. This gives an individual another 21 days to stop the foreclosure. At any point during either of these time periods, the bankruptcy can be filed. Once you file for bankruptcy, the foreclosure process stops. However, you cannot file bankruptcy to get property back once the trustee sale has occurred.
Stopping Creditor Harassment
Being in debt is a difficult situation to be in without having to deal with harassing calls from those to whom you owe money. Though creditor harassment is an unpleasant experience for any individual, there are avenues through which an end to the harassment can be pursued.
After you have filed for Chapter 7 bankruptcy or Chapter 13 bankruptcy, a creditor will receive notice of the filing. After this notice is received, an automatic stay is put into effect. This means that your creditors are not allowed to do anything in an attempt to collect on a debt during the time that the stay is in place. Some of the types of forbidden actions are listed below.

- Continuing to mail bills
- Foreclosing on or repossessing a property
- Wage garnishment
